IMMIGRATION UNION
BC/YT Regional Council
SECTION 1: REGIONAL COUNCIL
(a)
The
Regional Council shall represent all members of British Columbia and the
Yukon Territory. (BC/YT)
(b)
The BC/YT Regional Council
shall consist of every Local President or his/her alternate, the National
Vice President, the Alternate National Vice President, the Chair of the
Women’s Committee or her Alternate, the District Women’s Coordinators or
their alternates, the District Directors or their Alternates.
SECTION 2: PRESIDENTS’ CONFERENCE
(a)
The supreme governing
body of the Regional Council shall be the Regional Presidents’ Conference.
(b)
The Regional Council shall
hold at least one Regional Presidents’ Conference each year.
(c)
The delegates to the
Presidents’ Conference shall be the Presidents of each Local, or their
Alternate, the National Vice President, the alternate National Vice
President, the Chair of the Women’s Committee or her alternate, the
District Women’s Coordinators, the District Directors, the Chair of the
Regional Immigration Committee and, at the Presidents’ Conference held just
prior to the Triennial National Convention, the National Vice
President-elect and the Alternate National Vice President-elect.
The Regional Presidents’ Conference shall:
i)
deal with matters of
particular interest to, or concerning the welfare of the members in this
Region provided that are within the bounds of these By-laws and the National
By-laws;
ii)
establish
the regional budget, including any supplemental assessment of dues required
to fund regional operations and activities;
iii)
receive the reports of
Committees established by the Regional Presidents’ Conference or Regional
Council Executive;
iv)
confirm the National Vice
President, BC/YT, as Chairperson of the Regional Council Executive; and
(v)
confirm the District
Directors elected by their respective Districts.
SECTION 3: REGIONAL EXECUTIVE
COUNCIL
The Regional Executive Council (REC) shall
include the National Vice President, BC/YT, the Alternate National Vice
President, the Chairperson of the Women’s Committee or her Alternate, the
District Directors which include Citizenship and Immigration, and shall be
responsible for the affairs of the Regional Council between Regional
Presidents’ Conferences. Without limiting the generality of the foregoing,
the Regional Council Executive shall:
(a)
meet at least twice a
year;
(b)
administer the finances of
the Regional Council and prepare the necessary budgetary provisions;
(c)
undertake the necessary
preparations for the holding of Regional Presidents’ Conferences and any
other Regional Conferences deemed necessary
(d)
co-operate with the
National Executive of the Union in the discharge of the Union’s
responsibilities towards the membership;
(e)
establish any committee
it deems necessary to carry out its duties and responsibilities;
(f)
make such regulations as
are necessary for the administration of the Region, provided such
regulations do not conflict with these By-laws, the National By-laws or the
Constitution of the Public Service Alliance of Canada.
SECTION 4: FINANCIAL AUDIT
The Regional Council Executive shall
appoint a qualified accountant to conduct a formal independent audit for the
calendar year financial operations of the region and prepare an audited
statement for presentation at the next Regional Presidents’ Conference.
This shall be circulated one month prior to the conference.
SECTION 5: BY-LAWS
The Regional Council may set up its own
supplemental By-laws and Regulations, and shall be empowered to alter or
rescind same, provided such By-laws and Regulations do not conflict with the
By-laws of the Union and the Public Service Alliance of Canada Constitution.
SECTION 6: DISTRICTS
Locals in the BC/YT Region shall be
grouped geographically into districts according to Appendix B of the
Canada Employment and Immigration Union By-laws.
(a)
The District will be headed by a District Director. The District
Director and her/his alternate will normally be elected for a three-year
term, beginning and ending at the first District Meeting (as mandated in
the BC/YT Bylaws and Regulations) immediately after National
Convention. Candidates for District Director and alternate should be
nominated at least 30 days prior to the election date from amongst the
members of the district. Nominated members must be members in good
standing within the District and must agree in writing to be a candidate
for election for the position of District Director or alternate.
The election will be by a simple
majority of the District Presidents or their alternates and the District
Women’s representative or her alternate.
In the event of the position becoming
vacant during the term of office the position will be filled by the
alternate District Director and an election will be held for the
position of Alternate District Director for the remainder of the term.
(b)
Each District shall elect a District Women’s Coordinator. The
District Coordinator and her alternate will normally be elected for a
three-year term, beginning and ending at the first District Meeting (as
mandated in the BC/YT Bylaws and Regulations) immediately after National
Convention. Candidates for District Women’s Coordinator and alternate
should be nominated at least 30 days prior to the election date from
amongst the members of the district. Nominated members must be members
in good standing within the District and must agree in writing to be a
candidate for election for the position of District Women’s Coordinator
or alternate. The election will be by a simple majority of the District
Director, District Presidents or their alternates and the
District Women’s representative or her alternate.In the
event of the position becoming vacant during the term of office the
position will be filled by the alternate District Director and an
election will be held for the position of Alternate District Director
for the remainder of the term.
(d) Only local presidents or their
alternates and the district women’s representative or her alternate
shall be entitled to vote at a District meeting.
(e) The district will operate as an
administrative arm of the Regional Council and deal only with matters of
particular interest to the locals within the district.
(f) When a local president is elected
to District Director, she/he shall relinquish the position of local
president and the first VicePresident shall assume the office.
(g) When the alternate assumes the
responsibilities of the District Director, a new alternate will be
elected.
(h) In the event of an emergency where
the District Director and the alternate are not available, any member in
the district may be designated by the Presidents of the District to act
temporarily in place of the District Director.
(i) A District Director may attend
meetings of any local in her/his respective District, and shall be an
ex-officio member of all local executives with voice but no vote.
(j) Attendance at the District meetings
shall include the District Director and her/his alternate, the
presidents or their alternates of the locals in the district, the
District Women’s representative or her alternate, and may include any
other member required by the District Director to encourage union
participation and training.

A REGULATION GOVERNING
MEETING QUORUMS
-
A quorum at a Regional
Presidents' Conference shall be the National Vice President for BC/YT, 3
District Directors, and 25 Local Presidents.

A quorum at a Regional
Executive Council meeting shall be the National Vice President for BC/YT
or Alternate and 4 District Directors or 3 District Directors and the
Women's Committee Chair.
-
For purposes of quorum, an
alternate to any of the above noted offices shall be deemed to be the
office holder if attending the Conference or meeting in that capacity.

follows:
A REGULATION GOVERNING
ATTENDANCE AT
CONVENTIONS OF THE BC
FEDERATION OF LABOUR AND
THE YUKON FEDERATION OF
LABOUR
-
A Federation of Labour
Convention attendance fund in an appropriate amount shall be established
annually for the purpose of assisting Districts in meeting the expenses
of delegates. Only one delegate from each District shall be eligible
for expenses under this regulation.
-
A maximum amount of
$750.00 shall be payable to a delegate from a District to cover
reasonable expenses and shall be payable upon presentation of an
appropriate expense claim form and receipts.
Notwithstanding the foregoing,
a maximum amount of $750.00 shall be payable to a delegate from Local
20956 attending the Yukon Federation of Labour convention to cover
reasonable expenses and shall be payable upon presentation of an appropriate
expense claim form and receipts.

A REGULATION GOVERNING
CLC WINTER SCHOOL SCHOLARSHIP
Statement of Intent
This fund was established to encourage
members to participate in this in-residence training experience.
-
CEIU BC/YT may award a maximum of two
individual scholarships of one thousand dollars ($1,000.00) each to
attend the CLC Winter School each year.
-
The Regional Executive Council will
advertise the scholarships and Terms of Reference to the members a
minimum of 30 days prior to the application deadline.
-
The Terms of Reference may vary from
year to year depending on the training needs of the region. It will be
the responsibility of the Regional Executive to set out the terms of
reference in consultation with the Training Committee, and to grant any
scholarship(s)
Application Process
Applications must be accompanied by a
motion of support from the members Local documenting any financial
assistance to be provided to the member from Local funds, and be submitted
to the District Director prior to November 30th of the year
preceding the Winter School session for endorsement and submission to the
Regional Training Committee.
Application must include a written
statement from the member indicating how attendance at the CLC Winter School
will assist them in their union responsibilities.

HONORARIUMS

The members of the
Regional Executive Council shall be provided an honorarium of three
hundred dollars a year, which shall be paid in two instalments in June
and December.

A REGULATION GOVERNING EXPENSE
REIMBURSEMENT
1.
A member on approved union
business shall travel by the most economical means and claim expenses in
accordance with this regulation.
2.
For greater clarity, expense
claims covering less than one day shall cover costs in accordance with BC/YT
Region Regulation #6.
3.
When traveling by private motor
vehicle a member shall be entitled to claim the mileage/kilometer rate
specified by BC/YT Region Regulation #6.
4.
A
member shall be entitled to claim the current reimbursement for time spent
on authorized union business in accordance with BC/YT Region Regulation #6.
5.
While in travel status for one
day or more, a member shall be paid the current per diem allowance plus
actual accommodation costs, if any, in accordance with BC/YT Region
Regulation #6.
6.
For purpose of reimbursement,
the authority for authorization to incur expenses and approve claims shall
be the Finance Committee or the Portfolio holder of a Committee, as
appointed by the BC/YT Regional Executive Council.

Under the Authority of
the BC/YT Region By-laws, Section 3(f), the Regional Executive Council
enacts the following:
A REGULATION GOVERNING EXPENSE REIMBURSEMENT
Part A:
Wage Loss:
Actual wage loss will
be paid for time spent on union business during a working day where the
member provides LWOP documentation. Deductions will be taken at source for
EI, CPP and Income Tax. A T4 slip will be sent to the member at the end of
the fiscal year as required by law.
Part B:
Re-imbursement for
work on a Non-Working Day:
Members who do union
work on an AWA day, Annual Leave Day, or Non-Working Day may claim a fee per
day pro-rated by the time spent. This fee will be taxable at source. The fee
amount will be determined by the BC/YT Regional Council taking into account
the activity and the budget implications and will be reviewed on a yearly
basis. The current rate will be found in the CEIU BC/YT financial
Guidelines.
Part C:
Per Diem:
A per diem will be
paid for full or part days for re-imbursement of meal costs in an amount to
be reviewed yearly by the Regional Council and keeping in mind the current
rate being paid by National CEIU. The council will determine the amount of
the per diem, taking into account the activity funded as well as budget
available. Any per diem paid is non-taxable. The current amount of the per
diem will be reflected in the BC/YT CEIU Financial Guidelines.
Part D
Incidentals:
Incidentals may be
paid for union work done while a member is in travel status that requires an
overnight stay. The amount of the incidental will be reviewed yearly and the
amount paid will be determined based on the activity and the budget. The
current amount of any incidental will be reflected in the BC/YT CEIU
Financial Guidelines.
Part E:
Travel:
(1)
Travel
Status: When required to travel to meetings in a private vehicle, the
mileage or kilometer rate shall be the rate specified in the current CEIU
National Regulation. Shared private travel or rental vehicles are encouraged
when it is the least expensive method of travel.
(2)
Air travel: Re-imbursement at the most
economical and practical means.
(3)
In
Lieu of Air Travel: If the member chooses to travel by vehicle the maximum
claim will be the 14 day advance airfare or the actual mileage at current
CEIU National Regulation amount, whichever is less
(4)
Accommodation: shall be reimbursed at the
actual hotel rate or private rate as per Treasury Board Travel Policy.
Shared accommodation shall be encouraged, with the exception being
convention where non-delegates must share rooms or must pay for the other
half of the room costs unless prior arrangements are made for special
circumstances.
Part F:
Dependent Care:
Re-imbursement for
dependent care will be made when it is needed in order for a member to fully
participate in union activates and where the care is needed in addition to
the normal care provided on a daily basis for non-union activates. The rates
will be reviewed on a regular basis and will be set out in the CEIU BC/YT
Dependent Care Policy
Note: Rates for this
policy will be reflected in the BC/YT Regional Financial Policy and will be
changed from time to time as the REC reviews the budgets and the National
CEIU and PSAC policies to ensure that the rates are in keeping with these.
Special circumstances will be determined by the NVP in conjunction with the
appropriate committee.

the BC/YT By-laws, Section 3(f), the Regional Executive Council enacts as
follows:
A REGULATION
GOVERNING CHILD AND DEPENDANT CARE
-
The objective of this regulation is to remove the barriers which
prevent members from participating fully in the Union. For the purpose
of this regulation, a child or dependant is a minor who resides
permanently
with a member to the completion of age eighteen (18).
-
Upon request of at
least one participant, provisions for child and dependent care shall be
made available for all National, Regional, and District functions
including any evening sessions if they form part of the schedule of
events. Child care will be provided on-site at no cost to members.
Payment will be made for reasonable expenses incurred, including;
-
When accompanied
by a receipt, the cost of meals incurred by child/ dependent while
under such care to a maximum of $60.00 per day, and;
-
Incidental
expenses to a maximum of $5.00 per day per child/dependant.
-
Payment will be made
for reasonable expenses incurred when a member must obtain care for a
child/dependent because of absence due to approved union activity taking
place outside of the member’s normal working hours when the
child/dependant would not normally be in care or in school.
-
If the care is
provided by someone other than a professional caregiver the maximum
reimbursement rate will be $35.00 per day for the first
child/dependant and an additional $10 per day per each additional
child. If overnight care is provided, an additional $25.00 will be
paid for the first child/dependant and an additional $10 per each
additional child/dependent for each night. Payment will be issued
by CEIU BC/YT directly to the caregiver upon receipt of a claim from
the member which must include the caregivers name, address, and
Social Insurance Number.

If care is
provided by a professional caregiver, the rate of reimbursement will
be at the actual cost and paid directly to the caregiver by CEIU
BC/YT upon receipt of an official invoice including the name and
address of the professional caregiver or agency.
-
Notwithstanding the
foregoing, consideration will be given for special or unusual
circumstances.
-
Any dispute with
respect to a claim for child/dependant care will be referred to the
Regional Women’s Committee (as per the Committee’s Terms of Reference)
for resolution.

Section 3(f), the Regional Executive Council enacts as follows:
A REGULATION GOVERNING APPOINTMENTS TO
COMMITTEES
1.
A
special or standing committee may be created or dissolved by either the
Regional Council or the Regional Executive Council.
2.
Committee appointments shall be
made by the Regional Council or Regional Executive Council, as the case may
be.
3.
Whenever
possible, and depending on the mandate of special or standing committee,
appointments shall be based on the following criteria:
(a)
the
need for geographical (district) representation; and/or
(b)
the
need for representation according to occupation; and/or
(c)
the
need for representation based on employment activity.
4.
The
tenure of a committee appointee, unless otherwise specified at the time of
appointment, shall terminate at the conclusion of the Regional Presidents’
Conference held in conjunction with the CEIU triennial national convention.
5.
Notwithstanding
the foregoing, a committee member may be removed from a committee for cause
by the Regional Council or the Regional Executive

Council, as the case may be.

Under the authority of
the BC/YT region By-laws, Section (f) the Regional Executive Council enacts
as follows:
A Regulation Governing Honours and Awards
1.
The BC/YT Regional Executive
Council may confer upon a member, a Certificate of Recognition for service
to the union over a period of years or for a singular contribution worthy of
such recognition.
2.
A nomination for a Certificate of Recognition may be submitted by a
chartered BC/YT Local as approved by a general membership meeting of the
Local, and forwarded to the Regional Honours and Awards Committee and/or
portfolio holder.
3.
The Regional Honours and Awards Committee and/or portfolio holder may
be named by the Regional Executive Council and may recommend the awarding of
a Certificate of Recognition as nominated by the chartered local.
4.
Notwithstanding the foregoing, the regional Executive Council may
nominate a member for a Certificate of Recognition in exceptional
circumstances.
5.
A nomination for a Certificate of Recognition shall be accompanied
by:
(a) the minutes of the general membership meeting which voted on the
nomination;
(b) a resume of the nominee
(c) the reasons for the nomination.
6.
Not withstanding the foregoing, any person or organization of the
union may be awards a Certificate of Solidarity and, in such cases, the
procedure outlined above shall apply.
7.
Any nomination for an award must be received by the NVP at least 60
days prior to the Regional Presidents Conference or Local meeting where the
award is to be presented.

A REGULATION GOVERNING LIFE MEMBERSHIP
FOR BC/YT
-
Nominations for Life Membership in the
BC/YT Region of the Canada Employment and Immigration Union may be made
by any member of the region in respect of any member who has made
outstanding contributions to the region.
-
Nominations will be submitted to the
National Vice President BC/YT.
-
All decisions on the awarding of Life
Membership of the BC/YT Region of the CEIU shall require a two-thirds
(2/3) majority of the Regional Council.
-
Members in receipt of Life Membership
may be granted the right to participate on any committee in the region.
